These terms govern your use of the NeuraPBX mobile app for iOS and Android. By installing or using the app you agree to them. For data handling, see the mobile app privacy policy.
The app is a client — a softphone — for a NeuraPBX phone system that you or your organization hosts. It is not a telephone service and it is not a telecommunications carrier. It places and receives calls only through the NeuraPBX server you connect it to, over whatever SIP trunks or carriers that server is configured to use. Without your own NeuraPBX server, the app does nothing.
Do not rely on this app to contact emergency services. As a VoIP application it may be unable to place emergency calls, and any such call may fail or may not transmit your location to a dispatcher. It depends on power, internet connectivity, your device, your NeuraPBX server and your carrier — any of which can be unavailable exactly when you need help. Emergency call handling, if available at all, depends entirely on how your administrator has configured your system and carrier. Always keep a traditional landline or a mobile phone with cellular service available for emergencies.
Subject to these terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on devices you own or control, for use with a validly licensed NeuraPBX system. You may not sell, rent, sublicense or redistribute the app, remove or obscure proprietary notices, or attempt to reverse-engineer, decompile or derive source code from it except to the extent that restriction is unenforceable under applicable law.
You are responsible for the accuracy of the server address you enter and for keeping your credentials confidential. Anyone with access to your unlocked device may be able to use your extension. Secure your device with a passcode or biometric lock, and sign out or remove the app from devices you no longer use. Notify your administrator immediately if you suspect unauthorised access.

You are responsible for complying with the telecommunications, privacy, recording-consent and data-protection laws that apply to you and to the people you call.
Content transmitted through the app — calls, messages, voicemail, contacts, recordings and transcripts — resides on your NeuraPBX server. We do not host, receive, monitor, back up or have access to it. Availability, retention, backup, security and lawful processing of that content are the responsibility of you and your administrator.
Call quality depends on your internet connection, device and network conditions, none of which we control. Your mobile carrier's data charges and roaming fees apply to your use of the app; we are not responsible for them. Operating-system updates or device restrictions may affect background operation, notification delivery or call handling.
We may release updates, and may change, suspend or discontinue features of the app at any time. Some updates may be required for continued compatibility with your NeuraPBX server. We are not obliged to support outdated versions.
The app is provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, or that the app will be uninterrupted, timely, secure or error-free. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
To the maximum extent permitted by law, NeuraPBX will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, revenue, goodwill, data or business interruption, arising out of or relating to the app — including any failed, dropped, delayed or misrouted call, any failure to reach emergency services, or any unauthorised access to your system — whether based in contract, tort, strict liability or otherwise, and even if we have been advised of the possibility of such damages. Our aggregate liability relating to the app will not exceed the greater of the amount you paid for the app (which for the app itself is zero) or US$50. Nothing in these terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.
The app is distributed through the Apple App Store and Google Play, and your use is also subject to those stores' terms. Apple and Google are not parties to these terms and have no obligation to provide support or maintenance for the app. On iOS, Apple is a third-party beneficiary of these terms and may enforce them; any claim that the app fails to conform to a warranty is a matter between you and NeuraPBX, and, to the extent required by Apple, your sole remedy may be a refund of the purchase price (which for this app is zero).
You may stop using the app at any time by uninstalling it. We may suspend or terminate this licence if you materially breach these terms. Sections that by their nature should survive — including acceptable use, disclaimers, limitation of liability and governing law — survive termination.
These terms are governed by the laws applicable to NeuraPBX's place of business, without regard to conflict-of-law rules, and the courts of that jurisdiction will have exclusive jurisdiction over any dispute — except that either party may seek injunctive relief in any competent court. If any provision is held unenforceable, the remainder stays in force.
